Terms of Use

Terms of Use of the Amorce Platform

These Terms of Use govern the relationship between the Diazinteregio association, headquartered at the Cinémathèque de Bretagne, 2 avenue Clemenceau, 29200 Brest, France,

and the users of its Amorce platform.

In summary

  • You agree to use the platform in compliance with applicable laws and regulations.
  • We comply with the GDPR and respect your personal data.
  • We guarantee that you can exercise all your rights relating to personal data.
  • The content provided by Diazinteregio members is not subject to prior moderation, and we are not responsible for any incorrect or inappropriate content published by members.
  • We make every effort to ensure the security and availability of the Amorce platform, but are bound only by an obligation of means.

Preamble

 1. Purpose of the Diazinteregio Association

Founded in October 2010, the Diazinteregio association aims to bring together archive centres and film libraries using the Diaz database as a tool for managing their audiovisual and cinematographic collections. Built around a community of users, its objectives are to:

  • create a shared “standard” for the indexing of cinematographic and audiovisual works,
  • explore prospects for software development in order to ensure joint application development,
  • pool information contained in the databases of the various member organisations,
  • promote interregional cooperation within France and internationally,
  • and implement any action aimed at promoting the missions of archive centres and film libraries.

2. The Amorce Platform

The Amorce platform was developed as part of the MeFiTer project within the “Digitisation of Architecture and Heritage” programme of France 2030, with the aim of making the content of Diazinteregio members publicly available online.

Diazinteregio holds no rights over the film content published on its platform. Only the Diazinteregio members who share film content on the Amorce platform own or hold usage rights to such content. Diazinteregio remains the owner of the content it has itself produced, including texts and audiovisual materials.

Article 1 – Definitions

  • Amorce Platform: the platform used to publish the collections of Diazinteregio members online.
  • User: any internet user accessing and browsing the Amorce platform.
  • Administrator: a person appointed by the association to manage access and provide technical administration of the platform.
  • Data: any information entered, indexed, or consulted on the platform (metadata, video files, photographs, technical descriptions, etc.).

Article 2 – Purpose of the Terms of Use

These Terms of Use define the rights, obligations, responsibilities, and limitations applicable to any user accessing and using the Amorce platform.

Article 3 – Access to the Platform

Access to the platform is free and open to all users.
However, certain advanced features require the creation of a personal account, protected by unique, strictly personal, secure, and non-transferable credentials.
The Association reserves the right, at its sole discretion, to suspend or terminate access to the platform for any user:

  • who fails to comply with these Terms of Use,
  • or who directly or indirectly compromises the security, integrity, or proper functioning of the platform.

Article 4 – Use of the Platform

The user undertakes to:

  • Not carry out large-scale extraction of data without prior authorisation;
  • Not alter, compromise, or attempt to circumvent the platform’s security mechanisms.

Article 5 – Intellectual Property

  • The intellectual property rights relating to the Amorce platform and its successive developments belong exclusively to the Diazinteregio association.
  • The indexed audiovisual content remains the property of each archive centre or film library holding such content, in accordance with their respective rights of management.
  • Any reuse for public dissemination or commercial purposes is subject to the explicit consent of the rights-holding organisation.
  • Content consulted on the platform may be viewed strictly for private and family use, to the exclusion of any public screening.

  • By way of exception, dissemination or use is permitted in an educational context, particularly for presentations in schools or universities, or within teaching materials.

  • Any other use, including public communication, duplication, reproduction, representation, or dissemination of content outside the above cases, requires the express prior authorisation of the rights holder.

Article 6 – Rights and Obligations of Diazinteregio Members Regarding the Amorce Platform

Member organisations acquire the right to use the platform. They are required to:

  • ensure that they hold the rights necessary to publish the content made available online,
  • provide appropriate contextualisation when publishing content,
  • ensure respect for the integrity and dignity of the individuals represented.

Members may publish or unpublish content at their discretion.

Article 7: Basis for Image Requests

Diazinteregio provides its members and users with an image request service facilitated via the Amorce platform. This service is purely technical. Under no circumstances does Diazinteregio act as a substitute for its members in the commercialisation of images shared on the platform. Diazinteregio members remain solely responsible for download authorisations and for setting the pricing and commercial terms applicable to the images made available.

Article 8: Personal Data & GDPR Compliance

In the course of using the Amorce platform, personal data may be processed for the purposes of documenting, disseminating, and promoting audiovisual archives, for archiving in the public interest or for scientific or historical research, in accordance with Article 89 of Regulation (EU) 2016/679 (GDPR).

Diazinteregio acts as a data processor, as the technical publisher of the platforms, on behalf of its members. The members remain fully responsible for GDPR compliance, particularly with regard to the lawfulness of processing, information provided to data subjects, and the management of their rights, for all personal data processed within the content they publish or consult.

Diazinteregio undertakes to comply with its obligations as a data processor under the GDPR and implements appropriate technical and organisational measures to ensure confidentiality, security, and overall compliance of personal data processing carried out as part of its missions.

Platform users also have rights over their personal data in accordance with Articles 15 to 22 of the GDPR, including:

  • the right of access, rectification, and erasure;
  • the right to restriction of processing;
  • the right to object.

These rights may be exercised by sending a request to the following address: contact@diazinteregio.org. In the event of an unresolved issue, users have the right to lodge a complaint with the competent supervisory authority, namely the French Data Protection Authority (CNIL) – www.cnil.fr.

Article 9 – Platform Security

  • The platform is subject to technical and organisational security measures (data encryption, regular backups).
  • Each user is responsible for maintaining the confidentiality of their login credentials and undertakes to report any suspected compromise immediately.
  • Regular security and compliance audits may be carried out at the initiative of the association or at the request of members.

Article 10 – Platform Developments

The Diazinteregio association oversees the technical development of the Amorce platform in consultation with its members. Members may propose improvements, which will be subject to collective validation.

Any major modification to these Terms of Use will be notified to users at least 60 days before it enters into force.

Article 11 – Liability

  • The association cannot be held liable for any inappropriate, unlawful, or fraudulent use of content.
  • In the event of an incident affecting the integrity or availability of data, a business continuity and disaster recovery plan (BCP/DRP) will be activated in accordance with procedures defined by the association.

Article 12: Hosting of the Amorce Platform, Member Data and Video Consultation Files

Diazinteregio has chosen OVH servers hosted in France as its hosting solution. Diazinteregio has entrusted installation, configuration, and maintenance to the company Diateam.

Article 13 – User Code of Conduct

When using the Amorce platform, each user undertakes to adopt respectful, professional behaviour consistent with the values of the association. The following Code of Conduct applies to all users:

13.1. Data Integrity

  • It is prohibited to collect, falsify, or intentionally delete data.
  • Any action intended to harm the integrity of the Amorce platform or the reputation of the association constitutes a serious breach.

13.2. Reporting

Any behaviour that does not comply with this code may be reported to the platform administrators. Following review, the association may impose disciplinary measures, including suspension or termination of access, and, where appropriate, referral to the competent courts.

Article 14 – Governing Law and Jurisdiction

These Terms of Use are governed by French law. Any dispute relating to their interpretation or performance shall fall under the exclusive jurisdiction of the courts of Brest.
